British in Benidorm: which papers apply to you since Brexit

Since Brexit, Spain treats a British passport as a non-EU one, and your papers depend on one date. Settled here by the end of 2020? Then you are protected by the Withdrawal Agreement, and your card is a TIE. Arrived later, or arriving now? A visa comes first, as for any other non-EU national. Benidorm has welcomed British holidaymakers for generations, and plenty of them stayed.

Start my NIE

Settled here before the end of 2020

You are covered by the Withdrawal Agreement, which keeps your right to live here. The card that proves it is a TIE (Tarjeta de Identidad de Extranjero) mentioning the Agreement, and it carries the NIE you already had.

Some people still hold only the green certificate issued before Brexit, either the A4 paper or the small card. It can be exchanged for the TIE. In practice that means a fingerprint appointment, the toma de huellas, at a police office that issues cards, with your passport, the old certificate, a recent photograph and the paid 790-012 fee.

Keep the proof of your life here

  • Your padrón history from the town hall (certificado histórico de empadronamiento)
  • Rental contracts, or the deeds of your home
  • Spanish tax returns
  • Utility bills in your name
  • Registration with a local health centre

Arriving in Benidorm today

A British citizen who moves here now is treated like any other non-EU national. The visa comes first, from the Spanish consulate that serves your part of the UK: for most retirees that means non-lucrative residence, for others a visa to work, study, join family or work remotely. The TIE is issued after you arrive.

Without a visa, any time here is a visit. Visits are capped by the Schengen limit, 90 days within any 180-day period, counted across every Schengen country. Buying a home does not alter this, and the golden visa that once tied property to residence ended in 2025.

A flat here, a home in the UK

Owners who fly out for a few weeks at a time still need a NIE: for the purchase, for the utility contracts, and for the tax return Spain asks of owners who live elsewhere. They apply as non-residents on form EX-15, at a Spanish consulate before travelling, or at a police office in the province of Alicante once a cita previa is booked.

Questions on this floor

Is my pre-Brexit green certificate still any use?

It still records the rights you held, but the TIE is the card now issued to Agreement residents, and it is far easier to show at an airport, a bank or a hospital.

Can I take a job in Benidorm on a British passport?

If the Withdrawal Agreement covers you, yes. If you arrived later, only with a visa or an authorisation that allows work.

My partner joined me after 2020. Are they covered?

Possibly. The Agreement extends to some family members, depending on the relationship and when it began. Tell us the dates and we look at it with you.

Does owning a home here let me stay longer than 90 days?

No. Ownership and residence are different things. Unless you hold a visa or a TIE, the Schengen limit governs your stays, wherever in the area you spend the days.
